Terms of Service

Last updated: 3 July 2026 · LEADS (ABN 58 697 901 286) is operated by COSMIQ DIGITAL SOLUTIONS in New South Wales, Australia. All prices are in Australian dollars (AUD) and include GST.

These Terms of Service (Terms) govern your access to and use of the LEADS platform, websites, dashboard and related services (together, the Service). LEADS is a platform operated by COSMIQ DIGITAL SOLUTIONS (ABN 58 697 901 286), a business based in New South Wales, Australia (LEADS, we, us, our). By creating an account, funding a wallet, or submitting a campaign, you agree to these Terms.

If you book advertising as a business, the more detailed Advertiser Agreement also applies to you and forms part of these Terms. Where there is any inconsistency about advertising, the Advertiser Agreement prevails.

1. The Service

LEADS is a self-serve digital out-of-home (DOOH) advertising platform. It lets you create an account, upload image and video media, fund a prepaid wallet, and book that media to play on digital screens located in third-party venues across Australia. Plays are tracked, and where your media carries a QR code we may also track scans of that code for your reporting. We work hard to keep the Service available, but physical screen playback can be affected by venue power, network, hardware or access conditions that are outside our control.

2. Accounts & eligibility

  • You must be at least 18 years old and able to enter a binding contract. If you use the Service for a business, you confirm you are authorised to bind that business.
  • You are responsible for the accuracy of your account details, for keeping your login credentials secure, and for all activity under your account.
  • You must tell us promptly if you suspect any unauthorised use of your account.

3. Your content & review

You are responsible for everything you upload and for holding all rights and licences needed to display it — including the media itself and any website or destination a QR code points to. Because your ads appear on public and in-venue screens, every campaign is reviewed and approved by our admin team before it goes on screen. We may decline, request changes to, or remove content that is unlawful, misleading, infringing, adult, hateful, unsafe or otherwise unsuitable, in line with our Acceptable Use & Advertising Content Policy. We may suspend accounts that repeatedly breach those rules.

4. Wallet, billing, GST & refunds

  • The Service runs on a prepaid wallet. You add funds and your campaigns spend from that balance as they deliver. All amounts are in Australian dollars (AUD) and are inclusive of GST.
  • You can top up by card payment (processed and tokenised securely by Square — we do not store your full card number) or by manual bank transfer credited to your wallet once received.
  • As a GST-registered business, we issue a tax invoice for your records.
  • For rotation campaigns you are charged for the plays actually delivered; for reservation campaigns you are charged for the screen time you book.
  • If you stop a campaign early, the portion not yet delivered is returned to your wallet for future use. Only unspent wallet funds can be withdrawn — funds already spent on delivered advertising are non-refundable. The full detail is in our Refund & Cancellation Policy.
  • Promotional credit granted by LEADS may be applied toward advertising but has no cash value and cannot be withdrawn.

5. Reporting & measurement

The play counts, QR scan counts, heatmaps and other metrics in your dashboard are provided to help you understand delivery and engagement. They reflect our best measurement of plays delivered and scans recorded; they are an indication, not a guarantee of foot traffic, audience numbers, conversions or business outcomes.

6. No guarantee of specific placement

Subject to any reservation you book, we do not guarantee a specific number of impressions, a specific venue, or uninterrupted playback. Venues and screens may change, and individual screens may experience downtime. Where plays we charged for were not actually delivered due to a fault on our side, that value is corrected back to your wallet.

7. Acceptable use

You must not misuse the Service — including by attempting to bypass campaign review, interfering with the platform or screens, uploading malware or deceptive QR codes, or using the Service to break the law. The full content rules are in our Acceptable Use & Advertising Content Policy.

8. Intellectual property

You keep ownership of the media you upload. You grant us a non-exclusive licence to host, reproduce, format and display that media on screens and in your dashboard for the purpose of delivering your campaigns and your reporting. The LEADS platform, software, branding and content remain the property of LEADS and its licensors.

9. Suspension & termination

You may stop using the Service and request closure of your account at any time. We may suspend or terminate access if you breach these Terms or the Acceptable Use Policy, if required by law, or to protect the Service, our venues or the public. On closure, any unspent wallet balance is dealt with under the Refund & Cancellation Policy.

10. Privacy

How we handle personal information is described in our Privacy Policy, which forms part of these Terms. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

11. Liability & consumer rights

To the extent permitted by law, we are not liable for indirect, special or consequential losses, or for loss of profit, revenue, goodwill or anticipated savings, arising from platform downtime, declined or removed campaigns, measurement variances, or hardware or venue issues. To the extent permitted by law, our total liability connected with the Service is limited to the amount you spent through the Service in the three months before the event giving rise to the claim. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded; where we are permitted to limit our liability for a breach of such a guarantee, we limit it to re-supplying the relevant service or paying the cost of re-supply.

12. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will take reasonable steps to let you know (for example, by notice in the dashboard or by email). Continuing to use the Service after a change takes effect means you accept the updated Terms.

13. General

  • Assignment. We may assign, novate or transfer our rights and obligations under these Terms (for example, if we sell or restructure the business), on notice to you. You may not transfer your account or these Terms without our written consent.
  • Independent parties. Nothing in these Terms creates any partnership, agency, joint venture or employment between you and us. Neither of us can bind the other.
  • Electronic communications. You agree that we may give you notices and other information electronically — through the dashboard, or by email to your account address — and that this satisfies any legal requirement for writing.
  • Force majeure. We are not responsible for failure or delay caused by events beyond our reasonable control, including power, network or venue outages, natural disasters, or the acts of third parties (including payment providers and venue operators).
  • Entire agreement. These Terms, together with the Advertiser Agreement, Acceptable Use Policy, Refund Policy and Privacy Policy, are the entire agreement between you and us about the Service and replace any earlier understanding.
  • Severability & waiver. If any part of these Terms is found to be invalid or unenforceable, it is severed and the rest continues in force. If we do not enforce a right immediately, that is not a waiver of it.
  • Survival. Clauses that by their nature should continue after your account closes — including intellectual property, liability, indemnity (in the Advertiser Agreement) and governing law — survive termination.

14. Governing law & contact

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State. For any legal question, email support@leads.cosmiq.au (COSMIQ DIGITAL SOLUTIONS, New South Wales, Australia).
